    Verdicts/Settlements (Case Results):
    • $12 million wrongful death verdict in Long Beach in an extremely difficult products liability case against Daimler Trucks whose 2009 Freightliner Columbia tractor trailer was designed with side-mounted Diesel fuel tanks. Decedent was driving the truck when, for reasons unknown, she veered off the I-710 and collided with a tree. Decedent survived the initial impact. However, the exposed side-mounted fuel tank on the driver's side was pierced by the truck's axle during the impact, causing Diesel fuel to spray out of the tank and erupt into flames. Decedent burned to death in an otherwise survivable crash due to the post-collision, fuel-fed fire. We alleged that the subject truck was defective in design due to the exposed side-mounted fuel tanks and proposed an alternative design of moving the fuel tank behind the cab where it is less vulnerable. Defendant Daimler argued its truck was safe and state of the art, with millions of similar trucks being sold and with no other manufacturer of Class 8 trucks putting the tank behind the cab.   We won at trial with the jury finding the truck's design defective and apportioning 100% fault to the defendant Daimler.Courtney, et al. v.     • $12.25 million verdict in Fresno County in a difficult wrongful death case involving a claim for premises liability by a spouse of only four years and where the decedent died of electrocution when the 28 foot advertisement banner he lifted came into contact with obvious voltage lines which exceeded public utility height regulations.  Zuniga v.     • $10 million verdict in Los Angeles Superior Court - Long Beach in a difficult wrongful death case for a dangerous roadway where an inexperienced 16 year old driver made an illegal left turn (driver admitted he knew it was a no left turn intersection but he turned anyway) and struck the decedent on a motorcycle (who defendants claimed was heavily impaired from marijuana use).      Webb, et al. v.     • $60 million verdict in wrongful death case involving a defective product that was venued in federal court in Orange County where the product was admittedly misused (the verdict was  affirmed by the Ninth Circuit Court of Appeals).     • $16.2 million verdict in a very difficult brain injury case against an employer where there was little evidence to support the negligent driver was acting within the course and scope of employment and where Plaintiff was wearing a non-Dot helmet (Defendant contended that Plaintiff would not have suffered the brain injury had he worn a DOT Approved helmet).Evans v. Charter College, Case No. MC 023778, Los Angeles Superior Court, Central District, 2015
    • $14.1 million verdict in a difficult wrongful death/motorcycle case for a dangerous condition of property against the State that was venued in Ventura where a teenage motorcyclist sped through a curve and into the opposing lane hitting another motorist head-on.  Shanks, et al. v. State of California, Case No. 56-2012-00423044-CU-PO-VTA, Ventura County Superior Court, 2015
    • $14 million verdict in a bad faith insurance action against Allstate Insurance Co. after Allstate acted unreasonably during settlement discussions in an underlying catastrophic injury case by first accepting and then refusing a $100,000 policy limits demand by a motorcyclist who became a paraplegic after he was struck by the vehicle driven by the Allstate insured. Madrigal v. Allstate, Case No. CV 14-04242 SS, United States District Court, Central District.   The bad faith verdict was later affirmed by the Ninth Circuit Court of Appeals.   Homampour also tried the underlying case which resulted in a verdict exceeding $10 million against the Allstate insured who was found to be 100% at fault for the accident.
