The 1999 Montreal Convention (MC99) controls airline liability and jurisdiction in international aviation accident cases. Though the MC99 text is unambiguous, passengers suing air carriers continue to confront daunting challenges when the airlines raise jurisdiction defenses which are really part of a strategy to limit passenger recoveries. The defenses raised most often are to personal jurisdiction over the carrier in the passengers’ chosen U.S. forum and forum non conveniens. The panel intends to explore these issues in light of recent cases, discuss how they have impacted cases like Ethiopian Airlines Flight 302, and address why the U.S. Supreme Court’s remarkable Ford v.
