    • In Texas, employees who suffer the results of false positive drug tests have not had recourse in the Courts to correct their record EVEN after the employee can establish conclusively that the drug test result was false.  The First Court of Appeals found a potential exception where the drug testing company was negligent in the handling of the process, allowing the employee to sue the company even when there is no direct contractual relationship between the employee and the drug tester.  This case was pending before the Texas Supreme Court when Ms. Armstrong presented to lawyers outlining and explaining this type of claim and what might be expected in the Court's anticipated decision. , Speaker on False Positive Drug Testing, All
