    • Ms. Diamond represented the Plaintiff-Appellant in Daniels v. Select Portfolio Servicing, Inc., 34 F.4th 1260 (11th Cir. 2022). In Daniels, the Eleventh Circuit held that the district court erred in dismissing a mortgagor's complaint because the mortgagor plausibly alleged that mortgage statements were communications in connection with the collection of a debt under the Fair Debt Collections Practices Act (FDCPA), 15 U.S.C. §§ 1692d1692e(10), and 1692f(1), and in connection with collecting a debt under the Florida Consumer Collection Practices Act (FCCPA), Fla. Stat. §§ 559.72(7), and 559.72(9); [2] The statements were related to debt collection because they expressly said that they were an attempt to collect a debt; [3]-The Truth in Lending Act (TILA) and its regulations did not foreclose the mortgagor's claims under the FDCPA and the FCCPA. Monthly mortgage statements required by the TILA, 15 U.S.C. § 1638, and its regulations could constitute communications in connection with the collection of a debt., 2022
