    Representative Clients:
    • Judge Sharp is co-counsel for the plaintiff class in Snyder v. UnitedHealth Group, et al., in the U.S. District Court for the District of Minnesota. The Complaint, filed under the Employee Retirement Income Security Act ("ERISA") on behalf of a class of some 150,000 individuals, alleges that the health insurance giant UnitedHealth breached its fiduciary duties under ERISA by failing to remove the Wells Fargo Suite, one of the worst-performing target date fund options on the market, from its employee 401(k) plan, costing the plaintiffs millions in retirement savings. The Complaint further alleges that UnitedHealth's Chief Financial Officer and executive leadership personally intervened to keep the poorly performing Wells Fargo Suite on the plan because Wells Fargo was a critical customer and financier for UnitedHealth.    The Court, having certified the class action, has ordered the case to trial. , 2024
    • Judge Sharp has been litigating on behalf of over 60 local governments in Virginia in their claims against dozens of the largest companies in the opioid supply chain, including drugmakers such as Purdue Pharma, drug distributors such as McKesson, Cardinal Health, and AmerisourceBergen, retail pharmacies such as CVS, Walgreens, and Walmart, and pharmacy benefit managers such as Express Scripts, Optum Rx, and CVS/Caremark. In addition to representing municipalities in the multi-district litigation in the U.S. District Court for the Northern District of Ohio (In re: National Prescription Opiate Litigation), Judge Sharp is representing The City of Martinsville, Virginia, in Martinsville Circuit Court against opioid manufacturers, distributors, and pharmacy benefit managers (“PBMs”) for their role in creating the public health emergency caused by prescription opioids.    , 2024
