$5.3 Million Dollar Riverside County jury verdict on a spine injury arising from a T-Bone traffic collision. , 2022
$365,500 jury verdict resulting in a maximum allowable recovery in a medical malpractice case. An 87-year-old dementia patient went to Defendant’s outpatient imaging center for a routine CT scan of her brain when she fell trying to get off the exam table before it was lowered, falling to the ground and fracturing her upper femur (hip bone). Plaintiff was transported from the imaging facility by ambulance and thereafter underwent surgical repair with implantation of a rod and pin into her femur. After 5 days in the hospital Plaintiff spent an additional 73 days in a post-acute care facility. Due to COVID, Plaintiff’s family was not permitted to visit her in the hospital nor for the first two weeks at the post-acute care facility. Defendant’s CT tech was the only witness to what occurred and claimed at deposition that the patient was struggling to get off the table and that she helped Plaintiff off the table and slowly lowered her to the floor – never observing a fall. At trial the CT tech changed her story, claiming that she lowered the CT table, helped the Plaintiff stand up and only after seeing Plaintiff sway (seemingly dizzy), gently lowered the Plaintiff to the floor with the assistance of another employee. Defendant contended that Plaintiff never fell, it was reasonable to lower Plaintiff to the floor due to her dizziness, and the fracture likely occurred because she had osteoporosis and could occur from merely stepping off the table. Both stories provided by Defendant’s CT tech were undermined by another of Defendant’s employees who testified that the CT tech initially reported that the Plaintiff had fallen. Plaintiff’s expert radiologist, as well as a CT tech with 33 years experience, both opined that due to Plaintiff’s advanced age and presentation with dementia that Velcro safety straps, readily available on all CT tables, were required to have been placed across the Plaintiff’s torso during the exam to prevent her from getting off the table prior to the lowering of the table. The treating orthopedic surgeon who repaired Plaintiff’s hip testified that the nature of the Plaintiff’s fracture was caused by a force equal to a fall from standing height – which was about equal to the height of the CT table when raised for a scan. Plaintiff’s bio-mechanical expert cited multiple studies that supported the treater’s opinion and refuted that the fracture could be caused from Plaintiff being gently lowered to the floor. Due to her advanced dementia, Plaintiff was never able to provide an account of what happened to her and was never deposed. By the time of trial Plaintiff’s dementia had progressed to the point where she was in hospice care and unable to attend trial. 1M Jury Verdict - Hollowell v. Roadrunner Sports: Trial Attorneys Jeffrey T. Roberts and Michael Jeandron, of The Roberts Law Firm, secured a 1.02 million dollar jury verdict in Orange County Superior Court on May 24, 2018. After a two week trial, the jury found that Roadrunner Sports Inc., a chain retail store, was responsible for negligently designing a 5K run/walk route through a construction zone. A woman participating in the 5K tripped and fell on a .67 inch uneven surface while walking. She broke her knee cap and passed out from the pain. The jury awarded the full medical bills ($29,026.29) and 1 million dollars for pain and suffering. Defendants last highest offer a week before trial was $55,000. Plaintiff offered to settle for $500,000 (C.C.P 998) three months before trial and the offer was ignored. The jury trial was phase two of a bifurcated trial in which phase one dealt with the enforceability of an electronic waiver that Roadrunner Sports Inc. claimed the plaintiff signed online. The judge ruled that the electronic waiver was unenforceable and phase two commenced 30 days later, 2018

$1.34M Jury Verdict Villalobos v. County of Los AngelesDefendant's Highest Offer: $250,000. Description: Admitted liability minor impact side swipe between a Sheriff’s department inmate transport bus and Plaintiff’s Mercedes CLA 250. No airbags deployed, no EDR event recorded, car was drivable, and Plaintiff told everyone she was “okay” at the scene. Four days later she went to the chiropractor with neck pain and reticular symptoms. She underwent cervical spine MRI and two epidural injections. Then she stopped treating for 28 months. She returned to a neurosurgeon consultation. Surgery was recommended at C4-5, above where she preciously had surgery at C5-6. She delayed again until six years after the crash decided to undergo a C4-5 adjacent level surgery above her prior fusion. Plaintiff’s doctors testified that the prior fusion made her more susceptible to injury in a minor impact crash and that the MRI 2.5 months after the crash showed there were acute changes when compared to an MRI prior to the crash. Defense hired a biomechanical engineer to explain that the Delta V would be less than a 1 and would be the equivalent force on the body as sitting down in a chair. Defense hired an orthopedic surgeon to testify that the MRIs showed no acute changes and she would have needed the adjacent level surgeries anyway given her prior neck fusion. In the end, the jury awarded compensation for the neck fusion 6 years post crash and one additional fusion at the C6-7. , 2022
