Kiluk v. MBUSA: California Court of Appeal, Fourth Appellate District, Division Three - Opinion Certified for Publication. MBUSA refused to repurchase our client's vehicle. A jury found Mercedes Benz liable under the Song-Beverly Act for breach of both the express warranty and the implied warranties. The court entered judgment in favor of our client.
